Welcome to HealthFora, operated by HealthFora Pvt Ltd. These Terms of Service ("Terms") govern your access to and use of the HealthFora website, mobile applications and related services (the "Platform"). By accessing, registering on Platform, you acknowledge that you have read, understood and agreed to these Terms and Policies expressly incorporated into them.
1. Who Can Use HealthFora
- You must be at least 18 years old to create and operate an account in your own name. A parent or lawful guardian may use the Platform on behalf of a minor, where permitted by applicable law and remains responsible for ensuring that such use complies with these Terms and applicable law.
- By registering or using the Platform, you represent that the information provided by you is accurate, complete and current and that you have the legal capacity and authority to enter these Terms.
- HealthFora serves Patients, Doctors, Diagnostic Laboratories ("Labs") and Pharmacies. Doctors, Labs and Pharmacies must complete HealthFora's onboarding and verification process, including submission and validation of applicable licences, registrations and professional credentials, before offering services through the Platform.
2. Nature and Scope of the Platform
HealthFora is a technology-enabled marketplace and facilitation platform connecting Patients with independent healthcare professionals and service providers, including Doctors, Labs and Pharmacies. Except where expressly stated otherwise in writing, HealthFora does not itself provide medical diagnosis, treatment, laboratory testing, dispensing of medicines or other healthcare services.
- HealthFora is not a hospital, clinic, medical practitioner, diagnostic laboratory or pharmacy and does not practice medicine or dispense medicines.
- Doctors, Labs and Pharmacies are independent third-party providers and remain solely responsible for services, advice, diagnosis, reports, prescriptions, medicines and products supplied by them.
- HealthFora does not guarantee the accuracy, completeness, timeliness or clinical outcome of any consultation, diagnosis, test, report, prescription, medicine or other service supplied by a third-party provider.
- Provider verification supports onboarding and platform integrity and does not constitute an endorsement, certification or guarantee of professional competence or clinical outcome.
- Nothing on the Platform creates a doctor-patient relationship with HealthFora. Any professional relationship is between the Patient and the relevant healthcare provider.
Medical emergency disclaimer: The Platform is not designed for medical emergencies and must not be used as a substitute for emergency medical care. If you believe you are experiencing an emergency, contact the appropriate local emergency service or immediately attend the nearest emergency medical facility.
AI and automated features disclaimer: Any AI health assistant, report-analysis tool, symptom-related feature, recommendation, summary or other automated output is for general informational and administrative assistance only. It is not medical advice, diagnosis or treatment and may be incomplete, inaccurate, outdated or unsuitable for an individual's circumstances. Users must independently verify material medical decisions with an appropriately qualified professional.
Nothing in these Terms excludes or limits any right, remedy or liability that cannot lawfully be excluded or limited under applicable law.
3. Account Registration, Verification and Security
- Patients may register and log in using mobile OTP, while Doctors, Labs and Pharmacies may use email OTP or other authentication methods made available by HealthFora. HealthFora may modify authentication methods for security or operational reasons.
- You are responsible for maintaining the security of your registered device, phone number, email address, OTPs and other authentication credentials and for all activity conducted through your account.
- You must not share OTPs or authentication credentials or permit another person to access your account.
- You must promptly notify HealthFora at support@healthfora.in if you suspect unauthorized access, compromise, misuse or fraudulent activity involving your account.
- HealthFora may require additional verification, information or documentation, where reasonably necessary for security, regulatory compliance, fraud prevention or provider verification.
HealthFora may refuse, suspend or restrict registration or access where information is false, misleading, incomplete, unverifiable or where such action is reasonably necessary to protect users, comply with law or safeguard the Platform.
4. Consultations, Bookings, Services and Fees
- Consultation fees, diagnostic test prices, medicine prices and other charges are determined by the relevant provider and, where applicable, displayed before confirmation.
- By confirming a booking or placing an order, you agree to pay the applicable charges, taxes, platform/convenience fees and other disclosed amounts.
- Payments may be processed through third-party payment service providers, including Razorpay. Your use of payment services may also be subject to the applicable terms and privacy/security procedures of the payment provider.
- HealthFora may facilitate payment collection and settlement but, unless expressly stated otherwise, is not the supplier of the underlying medical, diagnostic or pharmacy service.
- Bookings and orders are subject to provider's availability and applicable regulatory requirements. HealthFora may cancel or restrict a transaction where required for legal, safety, fraud-prevention or operational reasons.
- Cancellations, rescheduling and refunds shall be governed by the policy displayed at the time of booking or purchase. The final policy must accurately reflect HealthFora's actual booking, payment and refund process.
- If a provider cancels or is unable to provide a confirmed service, HealthFora may, subject to the applicable policy, facilitate rescheduling or refund of amounts eligible for refund.
- Users must not initiate fraudulent chargebacks, payment disputes or refund claims. This does not restrict a genuine statutory or contractual remedy.
5. Pharmacy, Medicines and Diagnostic Services
- Where the Platform facilitates access to medicines or diagnostic services, the relevant Pharmacy or Lab is responsible for ensuring that the transaction and service comply with applicable laws, licenses, professional standards, prescription requirements, labelling, storage, dispensing, testing, reporting and record-keeping requirements.
- Prescription medicines shall be supplied only in accordance with applicable law and valid prescription requirements.
- Users must provide accurate prescriptions, patient and other information required for lawful fulfilment and must not upload forged, altered or fraudulent prescriptions or documents.
- HealthFora does not guarantee the availability, therapeutic efficacy, suitability or clinical outcome of any medicine or diagnostic service supplied by a third-party provider.
- Diagnostic reports and test results should be interpreted by an appropriately qualified healthcare professional, particularly where treatment decisions may depend on them.
6. Reviews and Feedback
- After a completed consultation or other eligible service, Patients may provide ratings and comments based on their genuine experience. Reviews must be truthful, relevant and non-misleading and must not contain unlawful, defamatory, threatening, abusive, discriminatory, confidential or unnecessarily identifying information about another person.
- HealthFora may moderate, restrict, refuse publication of or remove reviews that violate these Terms, applicable law or platform standards. Moderation is not an independent assessment of the clinical competence of a provider.
7. Doctor, Lab, and Pharmacy Obligations
Doctors, Labs and Pharmacies onboarding to HealthFora represent, warrant and undertake that:
- They hold and shall maintain all licences, registrations, qualifications, permits and approvals required under applicable law.
- All information and documents supplied to HealthFora are true, accurate, current, complete and not misleading.
- They shall promptly notify HealthFora of any suspension, cancellation, expiry, restriction or material change affecting their licence, registration or eligibility.
- They shall provide services in accordance with applicable laws, professional standards, ethical requirements and sector-specific regulations.
- They shall maintain appropriate records, patient confidentiality and professional safeguards as required by law.
- They shall not use the Platform for unlawful, fraudulent, misleading or prohibited activities.
- They are responsible for their own taxes, professional obligations, statutory filings, personnel and business operations, except to the extent expressly agreed otherwise in writing.
HealthFora may suspend, restrict or terminate a provider's access if verification fails, credentials lapse, information is false or misleading, applicable law is violated, a material safety concern arises, or continued access presents a reasonable legal, regulatory, security or reputational risk.
8. User Conduct and Prohibited Activities
You agree not to:
- Provide false, inaccurate, misleading or fraudulent medical, identity, prescription, payment or other information.
- Use the Platform for an unlawful purpose or to harass, threaten, abuse, defraud or harm another user or provider.
- Attempt to access another user's account, personal information, medical information or other data without authorization.
- Reverse engineer, decompile, disassemble, scrape, crawl, interfere with or circumvent technical or security measures of the Platform.
- Upload malware, malicious code or content intended to disrupt the Platform or compromise another user's device or account.
- Impersonate another person or misrepresent an affiliation with HealthFora or a provider.
- Post or transmit unlawful, defamatory, fraudulent, knowingly false, obscene, threatening or infringing content.
- Use provider contact information obtained through the Platform to circumvent HealthFora's booking/payment process where such conduct is prohibited by an applicable provider or commercial arrangement.
HealthFora may suspend, restrict or terminate an account and/or remove content where it reasonably believes that these Terms, applicable law, security requirements or the rights of another person have been violated.
9. Privacy, Personal Data and Confidentiality
HealthFora may collect and process personal data and health-related information in connection with registration, booking, consultations, payments, diagnostics, pharmacy services, customer support, fraud prevention and other Platform functions. Such processing shall be undertaken in accordance with applicable data-protection and privacy laws, including the Digital Personal Data Protection Act 2023 and applicable rules/provisions as and when applicable to the relevant processing.
The HealthFora Privacy Policy forms an integral part of these Terms and explains the categories of data collected, purposes of processing, disclosures, retention, security safeguards, user rights and contact/grievance mechanisms.
- Users shall provide accurate information and shall not knowingly upload another person's personal or health information without lawful authority.
- HealthFora may disclose information to providers, payment processors, technology vendors, regulators, law-enforcement authorities or other recipients where reasonably necessary to provide the Platform, comply with law, prevent fraud, protect safety or enforce rights.
- HealthFora shall implement reasonable technical and organisational safeguards appropriate to the nature of information processed, subject to applicable law and the Privacy Policy.
- Where applicable, users may exercise statutory data-protection rights through the mechanism specified in the Privacy Policy.
Users acknowledge that no internet transmission or storage system can be guaranteed to be completely secure. HealthFora does not guarantee absolute security despite implementing reasonable safeguards.
10. Intellectual Property
- All software, source code, design, graphics, logos, trademarks, text, content, databases, compilations, interfaces and other materials made available through the Platform are owned by or licensed to HealthFora Pvt Ltd and are protected by applicable intellectual property laws.
- Subject to these Terms, HealthFora grants you a limited, non-exclusive, non-transferable and revocable licence to access and use the Platform for its intended lawful purpose. You must not copy, reproduce, modify, adapt, distribute, sell, licence, publish, reverse-engineer or create derivative works from the Platform or its proprietary materials except as expressly permitted by law or in writing.
- You retain ownership of information and content lawfully submitted by you, subject to the rights and licences reasonably required by HealthFora to operate, secure and improve the Platform and comply with law.
11. Disclaimers
To the maximum extent permitted by applicable law, the Platform and its technology are provided on an 'as is' and 'as available' basis. HealthFora does not warrant that the Platform will be uninterrupted, error-free, secure, continuously available or suitable for every user's requirement.
HealthFora does not warrant or guarantee any particular medical, diagnostic, therapeutic, pharmaceutical or commercial outcome from a third-party provider. Nothing in these Terms is intended to disclaim a statutory warranty, consumer right or liability that cannot lawfully be excluded.
12. Limitation of Liability
- To the maximum extent permitted by applicable law, HealthFora and its affiliates, officers, directors, employees and service providers shall not be liable for indirect, incidental, special, exemplary or consequential loss or damage arising from use of the Platform, including loss of profits, revenue, data or business opportunity, except to the extent such exclusion is prohibited by applicable law.
- Without prejudice to liability that cannot lawfully be limited, HealthFora's aggregate liability arising out of or relating to these Terms or the Platform shall not exceed the amount actually paid by the relevant user directly to HealthFora for the specific Platform service giving rise to the claim during the [3/6/12] months immediately preceding the event giving rise to the claim, excluding amounts collected or passed through to third-party providers and subject always to applicable law.
- Nothing in these Terms shall exclude or limit liability for fraud, wilful misconduct or any other liability that cannot legally be excluded or limited.
13. Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless HealthFora, its affiliates, officers, directors, employees and service providers from claims, losses, liabilities, damages, penalties, costs and reasonable legal expenses arising from: (a) your breach of these Terms; (b) unlawful or fraudulent use of the Platform; (c) information or content submitted by you; (d) infringement of another person's rights by you; or (e) misuse of a medical, prescription, payment or other service.
This indemnity shall not apply to the extent a claim is finally determined to have resulted solely from HealthFora's own fraud, wilful misconduct or liability that cannot lawfully be indemnified.
14. Termination and Suspension
- You may stop using the Platform and request account deletion through support@healthfora.in, subject to applicable law, outstanding transactions, legal retention requirements and the Privacy Policy.
- HealthFora may suspend, restrict or terminate access where reasonably necessary because of a breach of these Terms, suspected fraud, unlawful activity, security risk, regulatory requirement, provider eligibility issue or conduct that may harm users or the Platform.
- Termination shall not affect rights or obligations accrued before termination. Provisions concerning payments, intellectual property, privacy, disclaimers, limitation of liability, indemnification, dispute resolution and provisions intended by their nature to survive shall continue after termination.
15. Grievance Redressal
- For complaints concerning the Platform, transactions, content, privacy or other matters, users may contact Priyanka Sahoo, legal@healthfora.in, +91 8117895474 and Baraboria, Jagatpur, Cuttack, Odisha, India-754200. HealthFora will process grievances in accordance with applicable law and its internal grievance mechanism.
- Where the Platform is subject to specific intermediary or e-commerce obligations, HealthFora should maintain the applicable disclosures and mechanisms required by law. Nothing in this clause restricts a consumer or user from approaching a competent statutory authority, consumer commission, regulator or other forum where such right is available.
16. Governing Law and Dispute Resolution
- These Terms shall be governed by and construed in accordance with the laws of India.
- Before commencing formal proceedings, the parties shall endeavor in good faith to resolve a dispute by written notice to legal@healthfora.in and discussion within [15/30] days, except where urgent interim or statutory relief is required.
- ARBITRATION: If HealthFora elects to use arbitration, disputes that are legally arbitrable shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator mutually appointed by the parties. The seat and venue shall be [New Delhi], India and the language shall be English. This clause shall not prevent a party from seeking urgent interim relief or exercising a statutory remedy that cannot lawfully be excluded.
17. Changes to These Terms
HealthFora may amend these Terms to reflect changes in law, technology, Platform features, services or business practices. Material changes shall be communicated through the Platform, email or another legally permissible method where appropriate.
The revised Terms shall state their effective date. Continued use after that date may constitute acceptance to the extent permitted by law. Where applicable law requires affirmative consent to material changes, HealthFora shall obtain such consent.
18. Force Majeure
HealthFora shall not be responsible for delay, interruption or failure caused by events beyond its reasonable control, including natural disasters, epidemic/pandemic events, war, terrorism, civil unrest, governmental action, regulatory restrictions, labour disruptions, power or telecommunications failures, cyber incidents affecting third-party infrastructure, or failures of internet, cloud or payment networks, provided HealthFora takes reasonable steps to mitigate the effects.
19. General Provisions
- Severability: If any provision is held invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary where legally permissible.
- Waiver: Failure to enforce any provision shall not constitute a waiver of that provision or any other right.
- Assignment: You may not assign or transfer your rights or obligations under these Terms without HealthFora's prior written consent. HealthFora may assign these Terms as part of a merger, restructuring, financing, sale of assets or business transfer, subject to applicable law.
- Entire Agreement: These Terms, together with the Privacy Policy and policies expressly incorporated by reference, constitute the agreement concerning use of the Platform, except for separate written agreements governing specific providers or services.
- No Agency: Nothing in these Terms creates a partnership, joint venture, employment, fiduciary or agency relationship between you and HealthFora or between HealthFora and any independent provider.
- Electronic Contracting: Acceptance by electronic means, including clicking an acceptance button, OTP-based authentication or continued use where legally permissible, may constitute electronic acceptance of these Terms.
20. Contact Us
